BCR Threatens Law Suit

Howard Baskin can you please advise why all of your Copyrighted photos and Videos have “Share” buttons on them if no one is permitted to post them?  This really makes little sense, are you intentionally wanting people to post them so you can threaten law suits?  The Photo in Question was originally posted on the BCR facebook photo album with the option to Share as well.

I do not know what you intend to research, but you can remove our photos and do whatever research you want.  There is no reason for me to suffer having our copyright violated for three weeks or any period of time while you research.

I sent you a copy of the email by certified mail today to be sure we gave you fair notice.

Unless I hear from you by end of day Sunday that you have taken the photos down, I will instruct our attorney, copied here, on Monday morning to file suit.

 Per your request the “Screenshots” of the photo have been removed from the referenced webpage even though the post is in accordance with “The Fair Use Doctrine”.

The fair use doctrine permits other people to use copyrighted material without the owner’s consent in a reasonable manner.  The fair use of a copyrighted work, which includes use for purposes such as criticism, comment, news reporting, teaching, scholarship, or research, is not an infringement of copyright.

Posting another persons personal information is harassment, unless that person voluntarily had posted his or her own information, or links to such information.

Personal information includes legal name, date of birth, identification numbers, home or workplace address, job title and work organization, telephone number, email address, or other contact information, whether any such information is accurate or not. Posting such information about another person is an unjustifiable and uninvited invasion of privacy and may place that person at risk of harm.

According to one of Big Cat Rescues websites: http://911bigcatrescue.com/report-animal-abuse/ and Domains By Proxy, LLC search, It is my belief that you own the website 911animalabuse.com.  

If this information is correct please be advised that I am receiving threats because of you posting my private information on your “Animal Abuse” website in attempts to discredit me.  I am not an animal abuser nor do I post false information on BCR and there is no reason for me to suffer, receive threats and have my life put in danger.  I have not posted this private information online and I am requesting that you immediately remove my personal information you were not given permission to post.

You will receive correspondence from Mr. Jakes regarding what we believe is your incorrect assertion regarding the Fair Use doctrine.  If you use the photo in the future, we will let a court decide.

I have no comment on the rest of your email and do not intend to engage in an email dialog with you except to say that you do post false information and I believe we have a right to defend ourselves and not allow you to attack us anonymously.  If you have any specific legal references for any of your statements feel free to send them and I will refer them to our attorney for review.  

To me the fact that you associate with and appear thereby to implicitly approve of what in our opinion is Joe Schreibvogel’s mistreatment of tiger cubs speaks to your level of concern for animals. I believe the idea that he has any concern at all for rabbits is ludicrous, particularly in light of the reports by his former employee about using live rabbits as feed for his non rehab cats, and I suspect that he laughs behind your back at how he has managed to lure you into joining his attacks on us. But I believe you have drunk his kool-aid and there is no point to further discussion.
