BCR Complaint – 7/17/12

April 22, 2012 in Admin

Attention Cause Members: Helpless Domestic Rabbits Need Your Voice!

Big Cat Rescue has a new baby bobcat which means more Live domestic rabbits, rats and turkeys will be unnecessarily sacrificed, tortured and killed.

BCR has not removed the videos of predation (domestic rabbits & rats being tortured and killed by bobcats in rehabilitation status) from their Internet Accounts which are in violation of Florida rule: 68A-9.006 Wildlife Rehabilitation Permit.

Please go to the Florida Fish and Wildlife Conservation Website and email the Commissioners here:

Please Be Sure to send a copy of the complaint from your Private Email Address to: myfwc@mailnj.custhelp.com

Subject: BCR / FWC Violations

7/17/2012

Attention:

FWC Chairman – Kenneth Wright
Board of Commissioners – Kathy Barco, Ron Bergeron, Richard Corbett, Aliese P. Priddy, Charles W. Roberts III,
Brian S. Yablonski

Big Cat Rescue Tampa was issued the following warning on 3/17/2011

“With regards to the allegations of exhibition of wildlife under rehabilitation status, FWC staff investigated and was able to confirm that BCR did, in fact, post a video on the BCR website and “Youtube” of wildlife being fed in rehabilitation status. BCR was advised of the violation and was ordered to remove the video from the public website and BCR corporate officer “Jamie Veronica Murdock” was issued a warning on March 17, 2011, for a violation of Florida Administrative Code (F.A.C.) 68A-9.006″.

I would like to file a new complaint on BCR regarding the continued violations of Florida Administrative Code (F.A.C.) 68A-9.006 since the complaint was originally filed on Oct 3, 2011 and dismissed by FWC with the following statement sent by Sabrina Manendez on 6/7/2012.

Re: FWSW11OFF9131,
“Lt. Delacure has advised that the videos of the three particular bobcats that were under Rehab status and are in question have been removed from any website that is under the control of BCR. Videos that make it onto the internet sometimes are not retrievable by the parties and therefore remains accessible by searches on the web. We are not aware of current violations regarding the 3 bobcats that the warning was issued for at this time”.

Lt. Delacure and FWC were aware of these violations as the following links have been submitted several times to the FWC office since 12/2/2011. All of the documentation submitted proves that the photos and videos factually belong to and were posted by Big Cat Rescue on their internet website accounts. FWC does not seem to be interested in going beyond the word of the owner of Big Cat Rescue and conduct a proper investigation or follow up on the warning that was issued to corporate officer Jamie Veronica Murdock on 3/17/2011.

Several complaints have been sent to Executive director Nick Wiley and Inspector General James T. Knight III of FWC regarding the poor quality of the investigations into complaints filed against BCR Tampa.

The following photos and videos of bobcats in rehabilitation are in violation of Florida rule:
68A-9.006 Wildlife Rehabilitation Permit.
(5) Standards for Wildlife Rehabilitation.
3. Wildlife undergoing rehabilitation or medical treatment shall not be exhibited. Permittees may keep wildlife with permanent physical impairments for educational display under permit in accordance with Section 379.3761, F.S., and Chapter 68A-6, F.A.C.

Photos and videos of wildlife being fed in rehabilitation status, bobcats in rehabilitation, and bobcats receiving medical treatment are all posted and have been online on these Big Cat Rescue Accounts for several years as well as the Personal Accounts of the BCR Staff. In fact,
BCR has recently posted photos of a new bobcat rescue dated July 9th, 2012 on the BCR website and Facebook account even after Jamie Veronica was issued a warning on March 17, 2011, for a violation of Florida Administrative Code (F.A.C.) 68A-9.006″.

I would like to request that FWC honor their regulations and ask BCR and their Staff members to take down all violations referenced on their Personal Accounts and Big Cat Rescue Accounts on the internet.

News Stories are reported on a regular basis displaying videos and photos of bobcats in rehabilitation status:    This is in violation of Florida rule: 68A-9.006 Wildlife Rehabilitation Permit. (5) Standards for Wildlife Rehabilitation.3. Wildlife undergoing rehabilitation or medical treatment shall not be exhibited. Permittees may keep wildlife with permanent physical impairments for educational display under permit in accordance with Section 379.3761, F.S., and Chapter 68A-6, F.A.C.

The News story below is regarding 2 blind bobcats however; the female bobcat is in rehabilitation status; Murdock says she may recover her eyesight and Big Cat Rescue will prepare her to return into the wild.

Photos of bobcats in rehabilitation are also posted regularly in BCR Newsletters – Big Cat Times and available on websites. This is in violation of Florida rule: 68A-9.006 Wildlife Rehabilitation Permit.

I would like to request that FWC honor their rules and regulations and stop BCR from posting photos and videos of bobcats in rehabilitation status on TV News, Internet News Articles and BCR Newsletters as there is absolutely no reason the public needs to see photos and videos of animals in rehabilitation status.

From 1997-2000 BCR did not live feed rabbits to rehabbing bobcats, in fact, below is an article about a very young bobcat that was successfully released at the BCR facility. It is my understanding that this bobcat lived in the back of the property and was released in October 1999 after being in captivity for 4 months. His diet was exactly like the other cats which consisted of chicken and meat. (frozen and already killed for human consumption).

As his hip healed the size of his cage increased, logs and limbs were added to observe his climbing abilities. The rehabber fed him by teasing him with a piece of chicken tied to a rope to watch him hunt and pounce. (The same rehab protocol other Ethical Rehabs use to raise and release bobcats). The article reads this was their second successful release that year.  Did FWC review why the change to live feeding was deemed necessary in later years?   Are there records stating these bobcats were micro-chipped by BCR and did the FWC Biologist find these bobcats died from lack of hunting skills?

Domestic rabbits have no wild instincts, cannot defend themselves and are easy targets. There is no logical reason to throw and trap live domestic rabbits inside an area of no escape to be torn apart alive. This is not hunting training when the prey has no chance of survival, it is deliberate and extreme animal cruelty. It would be greatly appreciated if FWC would Help Stop this barbaric in- humane killing of prey animals, instead of encouraging or supporting it.

Carole Baskin would like FWC to change their State Regulations so that BCR can continue to post these photos and videos of wildlife in rehabilitation status.
I would like to ask FWC Not to change their State Regulations to suit BCR.

“The Florida Wildlife Commission has taken the position that we are not allowed to post photos, videos or webcams of rehab bobcats outside of our volunteer force while a bobcat is going through rehabilitation. We have asked what we need to do to have the FWC reconsider their interpretation of the rule that rehab wildlife shall not be exhibited. There are a lot of places who post photos, videos, webcams and even have live exhibition of native Florida wildlife including major zoos, aquariums and rescue centers, but the FWC has told us we are not allowed to share photos, videos or webcams of our current rehab animals with you.

You can help us make a case before the Florida Wildlife Commissioners that this rule was implemented before the invention of webcams and non invasive ways to monitor rehabilitating wildlife by gathering evidence that this rule is not being enforced against anyone other that Big Cat Rescue who speaks out against private ownership and hunting of wild cats. Send your links, photos and videos to MakeADifference@BigCatRescue.org. The only evidence that will be helpful are native Florida wildlife who are undergoing rehabilitation for release back to the wild”.

Please send a case number and verification that the FWC Commissioners have received this complaint.

Thank you,
